Terms of Service

Last Updated: 27 August 2026

1. About this service

Aivatika provides appointment booking and customer communication software for healthcare and service businesses, primarily clinics, diagnostic laboratories and gyms. The platform lets a business manage enquiries and bookings over WhatsApp from a single dashboard, alongside a contact directory, message templates and booking records.

These terms apply to the business that registers an account ("you", "the Client"). By creating an account you agree to them.

2. Your account

  • You must provide accurate business information and keep it current.
  • You are responsible for activity under your account and for keeping credentials secure.
  • You must be authorised to act for the business you register.

3. WhatsApp Business Account

The platform operates on the official WhatsApp Business Platform. You connect your own WhatsApp Business Account through Meta's onboarding flow, and that account, its phone numbers and its message templates remain yours. Aivatika acts on your behalf, and you may revoke that access at any time.

Your use of WhatsApp is also governed by Meta's own terms and policies. Meta may suspend or restrict a WhatsApp Business Account independently of us, and we cannot reverse such decisions.

Messaging charges are billed by Meta directly to the payment method registered on your WhatsApp Business Account. These are separate from any subscription you pay to Aivatika.

4. Your responsibilities for message content

You are solely responsible for the messages sent from your account and for the lawful basis on which you contact recipients. In particular:

  • You must obtain valid consent before messaging a recipient, as required by WhatsApp's Business Messaging Policy and applicable law.
  • You must honour opt-out requests promptly.
  • You must not send content that is unlawful, misleading, harassing, or that infringes another party's rights.
  • You must not use the platform to deliver medical diagnoses, prescriptions or clinical advice. The service handles scheduling and administrative communication only.

5. Automated responses

The platform can answer routine booking enquiries automatically, drawing on the services, staff, prices and availability that you configure. You remain responsible for keeping that information accurate, and for reviewing and confirming bookings before acting on them. A member of your team can take over any conversation at any time, and customers can ask to speak to a person.

6. Acceptable use

You may not attempt to gain unauthorised access to the platform or another client's data, interfere with its operation, resell access without a written agreement, or use it to send bulk unsolicited messages.

7. Fees and cancellation

Subscription fees, billing period and any usage limits are those shown at the time you subscribe. Fees are payable in advance. You may cancel at any time from your account settings; access continues until the end of the paid period. Refunds are governed by our Refund Policy.

We may suspend or terminate an account for non-payment or for a breach of these terms, with notice where practicable.

8. Data and privacy

How we handle personal data is described in our Privacy Policy. Deletion requests are handled as described on our Data Deletion page. Customer data you process through the platform remains yours; we process it on your instructions to provide the service, and you are responsible for having a lawful basis to collect it.

9. Availability

We aim to keep the service available continuously but do not guarantee uninterrupted operation. Parts of the service depend on third-party systems, including Meta's WhatsApp Business Platform, whose availability is outside our control.

10. Liability

The service is provided on an "as is" basis. To the extent permitted by law, Aivatika is not liable for indirect or consequential loss, lost profits, or loss of data. Our total liability in any twelve-month period is limited to the fees you paid in that period.

11. Changes

We may update these terms. Material changes will be notified by email or in the dashboard before they take effect. Continuing to use the service after that constitutes acceptance.

12. Governing law

These terms are governed by the laws of India, and the courts of Bangalore, Karnataka have exclusive jurisdiction.
